British Royal Family Unlikely to Pursue Legal Action Against Harry and Meghan

It is a rare occurrence for members of the British Royal Family to take legal action against someone.

While they have legal teams in place to protect their interests and reputation, suing is not a common practice for them.

However, there have been instances in the past where they have resorted to legal measures.

For example, Prince Charles sued a newspaper for publishing his private journals.

Yet, it is not known whether the Royal Family has ever sued a member of their own family.

Although conflicts and disputes within the Royal Family have arisen, legal action is not typically the outcome.

Strict privacy laws safeguard the Royal Family, making it challenging to ascertain the truth.

Interestingly, Harry and Meghan have initiated nearly a dozen lawsuits over the past three years.

This further distinguishes them from other members of the Royal Family.

In general, the British Royal Family tends to avoid litigation.

Reports suggest that the Royal Family has no intention of suing Harry and Meghan for their recent public statements or anything mentioned in Harry's upcoming book.

Their rationale is that doing so would only draw more attention to the couple, which seems to be their aim.

However, if the former royals' next move pushes the Royal Family and their legal team beyond their limits, how would they proceed with a claim?

Considering that Harry and Meghan currently reside in California and have limited ties to the UK, any potential lawsuit against them by the Royal Family would likely need to be filed in a California court.

While this is not an insurmountable obstacle, it poses a practical challenge for the Royal Family.

They would require representation from US counsel and face the intangible hurdle of not being able to play the game on their home turf.

One reason why the Royal Family rarely resorts to lawsuits is that public funds support their activities.

Engaging in what could be perceived as frivolous legal battles using public money would not be viewed favorably by the public.

Family law attorney Sandra Choi emphasizes that this is more of a crisis management issue than a legal one.

While the family could potentially sue if Harry's memoir or any public statements made by him and Meghan are deemed defamatory by the Royal Family's legal counsel, the outcome would likely result in significant damage to their public image without substantial legal gain.

A recent report suggested that and Queen Consort might file a defamation suit against Harry in their personal capacity rather than as members of the royal family.

However, this approach seems illogical on multiple levels.

Even if the king and queen consort believed they had sufficient evidence to support a defamation claim against Harry's book or the statements made by both Harry and Meghan, enduring the lengthy and often invasive discovery process would make it unwise to pursue legal action.

In discovery, both parties would seek to gather facts related to the lawsuit, and this can be a protracted and distressing process where privacy is valued.

Another crucial reason why it is unlikely for the royal family to sue Harry and Meghan is that civil lawsuits are typically used when a party has suffered financial harm and seeks compensation from the court.

If the Royal Family grows tired of taking the high road and remaining silent, engaging in a legal battle would not be the most effective course of action.
